How to Handle the Really Tough Problems

Description:
Loss, damage and unauthorized use! Sooner or later every photographer,
editor or publisher is confronted by one or all of these nightmares. Deborah
Free and Jane Kinne will discuss a right and wrong way to address these
situations. This program gives you all the necessary tools and a road
map designed to ensure resolution and maintain a professional working
relationship. This session will include numerous useful handouts to establish
the ground rules for a hassle-free business. Adequate time will be set
aside for questions from participants.
You will learn:
- How to ask the right questions
- The five magic words that must appear on all
written communications during a dispute
- The correct terminology to include on your delivery
memos, invoices, terms of usage and model/property
releases (yes, under certain conditions releases are needed
for nature and animal photographs)
- When and how to hire an attorney
- A realistic evaluation of what to expect in resolving disputes

Speakers:
Deborah Free is owner of her own consulting company, Deborah Free - Image
Consulting, and travels the world to work extensively with both photographer
and stock agencies. She specializes in evaluating existing businesses,
offering shooting tips and
marketable suggestions, implementing new procedures and
sound legal practices and helping to identify new markets. She is continually
building on her extensive knowledge of the stock industry, taking that
knowledge to photographers to help them and their businesses grow to the
next level. She is the past president, CEO and manager of nature stock
agency Natural Selection.
Jane Kinne, of Russ Kinne, Inc., is best known as the industry's
foremost advocate of photographers' rights. With 50 years
experience as a photo agent and consultant, her association with NANPA
has brought her back to her first love, wildlife photography. After service
with Colonial Williamsburg, Audubon, Photo Researchers and Comstock, she
now serves as a consultant to National Geographic's Image Sales Division.
Jane has testified in 104 cases in the State and Federal courts, both
in the United States and Canada, involving issues of copyright, loss and
damage. She has served as an appointed member of the working committee
on Fair Use and the New Technologies at the United States Copyright Office.
Recently, she has served as mediator and neutral expert in photo industry
disputes. She is also the legal chairperson for both the Picture Agency
Council of America and the American Society of Picture Professionals.
